The Warsaw Restructuring and Insolvency Group has been advising clients for many years on the full spectrum of legal, litigation and tax matters related to restructuring and insolvency. We have unique expertise in working with creditors, in particular with financial institutions. We are also instructed by foreign insolvency office holders to handle cross-border proceedings and disputes. The close cooperation between the Polish and foreign members of the Group provides us with know-how in the most recent and innovative restructuring techniques. We are able to modify and tailor these solutions to local Polish conditions.
Bartosz Merczyński, Ph.D., heads the Warsaw Insolvency and Banking Litigation practice and works in tandem with the Restructuring Group. He has particular expertise in contentious restructuring, insolvency-related litigation, fraudulent conveyance claims, commercial loan recovery and enforcement actions. He is a licensed insolvency practitioner, a member of INSOL Europe and a qualified Polish legal advisor who has been with the firm since 2005. Bartosz graduated from the Law Faculty at Warsaw University in 2002. He has also completed postgraduate studies in bankruptcy law and restructuring at the European Higher School of Law and Administration. He holds a Ph. D. in cross-border insolvency law and civil procedure.
Tomasz Trocki is a counsel at Allen & Overy, A. Pędzich Sp. k. Tomasz specialises in finance, restructuring and insolvency law, and is an expert in restructuring projects. Tomasz has advised in the most of the ground breaking restructuring transactions in Poland involving restructuring of credit facilities, guarantee facilities, bonds, derivatives and other financial instruments. Tomasz joined the firm in September 2006 when he completed LLM studies at King’s College London where he obtained the Master degree in Banking and Financial Law. In 2010 he spent six months in the Restructuring group of Allen & Overy's London office. Currently, he is in the process of obtaining a Ph.D. degree in insolvency and restructuring law.
Paweł Bartosiewicz is a legal advisor at Allen & Overy, A. Pędzich sp.k. Paweł has experience in working in the team focusing on litigating and resolving complex insolvency matters in Poland for the firm's major international clients. He specialises in advising creditors, who participate in the bankruptcy proceedings. Paweł graduated from the Department of Law and Administration at the Nicolaus Copernicus University in Toruń and he completed two-year’s Introduction to English and European Union Law arranged by the University of Cambridge. In 2016 he defended his doctoral dissertation at Leon Koźmiński Academy (specialising in banking law). He is the author of publications regarding Polish insolvency proceedings, litigation and out-of-court restructurings.
